Trust and Estate Litigation
Richard A. Burton, Jr., Esq
Trust and Estate Litigation
Trust and estate litigation arises when disputes occur over the management or distribution of assets, often after incapacity or death. These cases may involve challenges to a will or trust, claims of undue influence, or concerns about how a trustee or executor is handling their responsibilities. Because they combine significant financial stakes with family dynamics, they are often both complex and emotionally sensitive.
Many disputes center on whether the individual’s true intentions are being honored. Beneficiaries may question a document’s validity or raise concerns about capacity, while fiduciaries can face allegations of mismanagement, self-dealing, or lack of transparency. Courts ultimately look to the governing documents and applicable law, but these conflicts can escalate quickly without proper guidance.
We help clients navigate these challenges by evaluating claims, protecting their rights, and pursuing practical solutions. Whether through negotiation, mediation, or litigation, I work to resolve disputes efficiently while minimizing stress and preserving what matters most to my clients.
